This privacy notice (“Privacy Notice”) describes how Time Study, Inc. (“Time Study”, “we”, “our” or “us”) obtains, uses and shares personal information and other information in connection with the operation of Time Study’s website, available at https://www.timestudy.co/ (the “Site”), and through its mobile application, products, and services (collectively the “Offerings”). Time Study’s Site provides potential and existing customers with information about our company, our Offerings and access to resources such as our newsletter. Our Offerings are used by enterprise customers, such as hospitals, to track practitioners’ time spent performing services to derive insights that drive progress. Our enterprise customers enter into a contract and/or other applicable terms (the “Underlying Agreements”) with Time Study that govern their use of the Offerings as well as Time Study’s use of the personal information obtained in connection with the Offerings. This Privacy Notice provides a general overview of Time Study’s data handling practices for our customers and we recommend reviewing the applicable Underlying Agreements for more details.

I. TYPES OF INFORMATION WE OBTAIN AND HOW WE USE IT

When you use the Site and the Offerings, Time Study obtains different types of information, including personal information. The table below lists the different types of information Time Study generally obtains from the Site and the Offerings and the source from which Time Study obtains such information.

If you are a customer or potential customer interacting with our Site, we may obtain:

  • Name and contact information (e.g., phone number and email address);

  • Employment information (e.g., job role, company name); and/or

  • Other information you choose to share with us (e.g., anything submitted in the free text “Message” field).

Note that some features of the Site may not work if you choose not to provide the requested information.

 

Offerings

The information a customer provides Time Study for implementation of the Offerings or when its authorized users utilize the Offerings may include:

  • Name and contact information for authorized users (e.g., phone number and email address);

  • Password for authorized users;

  • Employment information for authorized users (e.g., employee ID, job role, name of organization that the authorized user provides services on behalf of);

  • Location of authorized user, if location services are enabled;

  • Other information customers and authorized users choose to share when utilizing the Offering (e.g., budgets, voice notes, photos of authorized users, activity name, category and description of activity).

 

Cookies and Other Automated Means

Time Study and our service providers may also collect certain information when you utilize the Site and Offerings, including through cookies, web beacons, software development kits (SDK’s) and other technologies (collectively “Cookies”). We and our service providers use Cookies to administer and understand usage and improve our Site and Offerings. We may also use Cookies to collect aggregate information about users such as such as technical information about browsers and devices used to access the Offerings and information about crashes or other technical issues. The information collected for these purposes may be disclosed to or collected directly by our third-party web analytics service providers, such as Google Analytics. II. HOW WE USE THE INFORMATION OBTAINED

Time Study uses the information we obtain in connection with the operation of the Site and the provision of the Offerings for several purposes, including, but not limited to:

  • Making the Site and Offerings available (e.g., user account creation) and providing you with information or materials you may request (e.g., product demos);

  • Identifying, authenticating and managing user accounts for the Offerings;

  • Providing customer care and support for the Offerings;

  • Generating and analyzing statistics about use of the Site and the Offerings, including to provide usage information and improve the user experience for our Offerings;

  • Communicating with our customers and authorized users of the Offerings by email and other means, including sending informational, marketing and promotional communications about Time Study such as our newsletters;

  • For our marketing and advertising purposes, including interest-based advertising, relating to information collected on the Site;

  • Complying with and enforcing applicable industry and legal requirements (including legal process such as court orders, warrants or subpoenas) and fulfilling contractual obligations; and/or

  • Detecting, preventing, and responding to violations of this Privacy Notice, the Underlying Agreements, the applicable Terms of Use to the Site and Offerings, violations of law, fraud or theft, or other misuse of the Site or Offerings.

We may also aggregate the personal information we obtain through our Site or the Offerings (the “Aggregated Data”) and use it for analytics, benchmarking and other business purposes such as improving our products and services and publishing market studies. We may augment such Aggregated Data with data we obtain from other sources.

Internet-Based Advertising

In connection with our Site, Time Study and third parties may collect information about your online activities to provide you with advertising about services or products tailored to your interests. You may see certain advertisements on other websites because we or such third-parties participate in advertising networks. Ad networks track your online activities over time by collecting information through automated means, including through the use of Cookies.

The information ad networks may collect include information about your visits to websites that participate in the relevant advertising networks, such as the pages, advertisements or videos you view and the actions you take on the websites. This data collection may take place on the Site and on third-party websites or apps that participate in ad networks. This process allows us and third parties to deliver more tailored advertising. In addition, it helps us track the effectiveness of our marketing efforts. In serving interest-based ads, Time Study adheres to the Self-Regulatory Principles for Online Behavioral Advertising developed by the Digital Advertising Alliance . III. WITH WHOM WE SHARE INFORMATION

Time Study may share the information we obtain in connection with the operation of the Site and the provision of the Offerings:

  • With service providers who work on our behalf and other third-party partners that provide features or functionalities we integrate into our Site and Offerings including, without limitation, our cloud service provider and our email service provider;

  • With our attorneys, accountants, auditors or other advisors, as necessary or appropriate;

  • As we believe is necessary or appropriate to protect our rights or the rights of others including detecting, preventing and responding to fraud, potentially illegal activities or misuse of the Site and Offerings, intellectual property infringement or other violations of law, this Privacy Notice, the Underlying Agreements and applicable Terms of Use of the Site and the Offerings;

  • As we believe is necessary or appropriate to comply with or enforce applicable law or legal process, including responding to court orders, warrants, subpoenas and other requests from public and government authorities;

  • To the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition or sale of all or a portion of our assets (including in the event of a reorganization, dissolution or liquidation); and/or

  • With third-parties for any purpose with your consent or otherwise at your direction.

In addition, we may share Aggregated Data with third parties for any purpose.

IV. THIRD-PARTY LINKS AND FEATURES

Our Site and Offerings may contain links to third-party websites, including through social media features (i.e., Facebook, Twitter and LinkedIn). Time Study is not responsible for the collection or use of your information by such third-parties. We encourage you to review the privacy policies or other similar statements applicable to such third-party websites or features.

V. YOUR RIGHTS OVER YOUR PERSONAL INFORMATION

  • Email Marketing Opt-Out

You may unsubscribe from marketing and promotional communications such as newsletters by clicking on the unsubscribe link in each email.

Interest-Based Ad Opt-Outs

To learn more about your rights in relation to interest-based advertising on your browser, including your choice to opt-out, you can follow the instructions provided by the Digital Advertising Alliance (“DAA”) here and/or the Network Advertising Initiative (“NAI”) here to place an opt-out cookie on your browser. These opt-out Cookies enable you to block participating companies from installing future Cookies. These opt-out mechanisms are provided by third parties. Time Study does not control or operate these mechanisms, or the choices provided through these mechanisms.

  • Analytics Opt-Outs

The Site uses analytics, including third-party analytics provided by Google Analytics, to help improve the user experience and functionality. To opt-out of third-party analytics on your browser, please see here and follow the instructions.

VI. CHILDREN’S INFORMATION

The Site and Offerings are not directed to, nor does Time Study knowingly collect personal information from, children under the age of 13. If you become aware that your child or any child under your care has provided us with information without your consent, please contact us as indicated below.

VII. HOW WE PROTECT YOUR INFORMATION

We maintain reasonable administrative, technical and physical safeguards to protect the personal information we obtain through the Site and Offerings. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while we make reasonable efforts to protect your personal information, we cannot guarantee its absolute security.

VIII. INTERNATIONAL DATA TRANSFERS

The personal information collected through the Site and the Offerings will be processed in and subject to the laws of the United States, which may not provide the same level of protection for your personal information as your home country. The Site and the Offerings are intended for consumers located in the United States only.

IX. ADDITIONAL INFORMATION FOR CALIFORNIA RESIDENTS

Under California law, specific disclosures are required and California residents who access the Site may have additional rights regarding their personal information. Please review this section to learn more. The rights set forth below do not apply to authorized users of our Offerings.

a. Your California Consumer Privacy Act of 2018 (“CCPA”) Rights Residents of California who use the Site may have the following rights with regards to information collected by Time Study in connection with the Site:

i. Right to access your personal information. You may request to access the categories and specific pieces of personal information that Time Study collected about you.

ii. Right to deletion. Subject to certain exceptions, you may ask us to delete the personal information that Time Study collected about you.

iii. Right to disclosure. You may request to receive additional details about the sources from which Time Study collects information, the reasons we collect and share information, and the types of third parties with which we share the personal information we collected about you.

iv. Right to opt out of sales. Under CCPA, certain types of sharing of personal information may constitute a “sale” of your personal information. We do not sell your personal information to third parties for their own commercial purposes. To opt out of the use of your information for interest-based advertising, please use the opt outs include in the Interest-Based Ads Opt-Out section above.

v. Right to be free from discrimination. You may exercise any of the above rights without fear of being denied goods or services.

If you would like to exercise your CCPA rights with respect to the personal information we collected about you, including the right to opt out of the sale of your personal information, please contact us with your request by email at privacy@timestudy.co. For such requests, please put the statement “California CCPA Rights” in the body of your email, as well as your full name, email address, mailing address and specify the CCPA right you wish to exercise at this time.

b. Minors

We do not knowingly collect or disclose personal information of minors under the age of 16, without affirmative authorization.

c. Do Not Track

Time Study does not currently take steps to respond to browsers’ “Do Not Track” signals as no uniform standard to respond to such signals has been developed at this time.

X. CHANGES TO THIS PRIVACY NOTICE

We may update this Privacy Notice from time to time to reflect changes in our privacy practices or applicable laws. We may, as permitted by law, make such changes without prior notice. We will publish the updated version on the Site and indicate at the top of the Privacy Notice when it was most recently updated.
